LIVE PAINTING CONTRACT

Terms


Hanna Bruer will be referred to as the ‘artist’ for purposes of this contract and will be responsible for any and all statements referring to the artist and any assistants accompanying the artist. The person listed in the parties section will be referred to as the ‘client’ or the ‘recipient’ for purposes of this contract, and will be responsible for any and all statements referring to the client or appointed recipient. The ‘artwork’ listed within the contract refers to any and all work created by the artist for or during the event. The ‘service’ listed within the contract refers to live painting.

This contract is to confirm a live painting performance and custom artwork already discussed between the client and the artist.

PAYMENT

The artist will send an invoice to the client for a deposit and for the remainder. The deposit invoice will be sent within 2 calendar days of agreement of the contract, and the remainder invoice will be sent 15 calendar days prior to the event. The client is required to pay a 50% deposit to retain the artist for services and artwork. The balance of the agreed fee (charges minus deposit already paid) will be paid to the artist either on the day of the event or on receipt of an invoice from the artist. This is to be agreed prior to the event. Invoices must paid in full by the client within 15 days of the date on the invoices. The client can request the remainder invoice to be delivered and paid early if it is more convenient.

Payments can be made by available payment services through the invoicing and payments service at hannabruer.com or via another method agreed upon by both parties.

Unpaid charges or invoices will be pursued; after a fair and reasonable time, if invoices are not paid, legal action may be taken. Standard bank charges and interest will be charged for checks or other such money orders not honored by the client's institution.

The deposit or material costs already paid by the client is non-refundable, regardless of event cancellation or unwillingness to have the artist appear as requested. If the event needs to be cancelled or rescheduled to a date the artist not available, anything paid in advance(minus the deposit) will be refunded to you. In the unlikely event that the artist would have to cancel their performance, only 50% of the client’s deposit would be retained. The retention amount covers the cost of materials specific to the event. If additional artworks listed on the invoice, or other services rendered, a refund for these items cannot be given to the client.

CONFIDENTIALITY AND PRIVACY

The client’s personal details, addresses or contact numbers will not be forwarded to any third parties without written permission from the client. Likewise, the artist's personal details, addresses and contact numbers may only be forwarded to third parties for promotional purposes unless otherwise discussed and agreed upon by the artist.

INTELLECTUAL PROPERTY

The artist retains the copyright to the artwork. The artwork must not be resold, duplicated, altered, or reproduced in any manner. Legal action will be taken in the event of any infringements.

PRIVACY POLICY

By agreeing to this contract, the client acknowledges having read and understood the artist’s privacy policy listed here.

SERVICE DELIVERY AND EXPECTATIONS

Live Painting: On the day of the event, the artist agrees to arrive at the event in an acceptable amount of time in which to set up for live painting (30-45 minutes). The artist will make all possible efforts to remain convenient, appropriate, professional, safe, and accommodating to the client, event, and event attendees. The artist retains the right to be accompanied by an assistant if needed. The artist is responsible for the assistant, and the assistant agrees to all stipulations in the contract. The artist agrees to disassemble her live painting station as efficiently as possible.

Painting(s): The artist agrees to create a custom artwork for the client that falls in line with the artist’s style. The artist agrees to create an artwork consistent with her quality standards.

Changes to performance times, start times, or venue must be conveyed to the artist as soon as possible and agreed upon by both parties. Increases in performance times incur fees at the artist's discretion and paid as decided between both parties.

The client or appointed recipient of the artwork must collect the artwork from the artist at the proposed end of the event or other agreed upon time. The recipient of the work may collect the artwork from the artist in a public space agreed upon by both parties. Arrangements for pickup other than at the event must be made before the event. If the artwork cannot be collected by the client or appointed recipient within 7 calendar days of the event, the artwork is considered surrendered by the client.

SERVICE MODIFICATIONS

The custom painting(s) are considered final sale due to the nature of creative work. The artwork shall be completed by the end of the event or by a date agreed upon by both parties. If the artwork requires reasonable adjustments requested by either the artist or client, adjustments must be requested within 7 calendar days and agreed upon by both parties. Reasonable adjustments include minor changes and are not to exceed adjusting 5% of the artwork.

LIMITATION OF LIABILITY

In the event of injury, loss, damage or other matters that arise, both the client and the artist will take responsibility for their own liabilities. The artist is not responsible for any damages to the artwork once it is in the custody of the client or appointed recipient. The artist agrees to maintain cleanliness of the venue as much as possible. If any spills, stains, or other marks are incurred to the venue as a result of the artist’s supplies, the artist will have this cleaned in a reasonable manner.

INSURANCE

Please inform the artist if insurance is required for the venue. In most cases, the artist will carry a standard liability $1,000,000 policy with the venue listed as additional insured.

ARTIST SAFETY

If at any time during the event the artist is made to feel unsafe, threatened, or harassed in any manner, the artist retains the right to withdraw services and leave the event. The artist will first contact an event facilitator.

RIGHT TO TERMINATE
This contract is considered terminated if either party violates any terms.
